Subsidy Scam: Indicted Fuel Marketers Won’t be Prosecuted – Attorney General

The Attorney General of the Federation, Mohammed Adoke Bello, has stated that the fuel marketers indicted in the House of Representatives Adhoc fuel subsidy report will not be prosecuted.

The attorney general made the statement in a sworn affidavit deposed to at a Federal High Court in Abuja.

Adoke Bello is the third defendant in a suit brought against his office by Integrated Oil and Gas, owned by former Minister of the Interior, Captain Emmanuel Ihenacho. The suit lists the House of Representatives and Honourable Farouk Lawan as the first and second defendants respectively.

Integrated Oil and Gas, yesterday, secured an interim injunction restraining the Federal Government from acting on the report of the committee. The committee had recommended that Integrated Oil and Gas refund N 13.2 billion subsidy funds.

An affidavit deposed by the Managing director of integrated oil, Anthony Ihenacho said, ““Up till date, the applicant does not know how the 1st and 2nd (ad hoc committee and Farouk Lawan) respondents arrived at their decision that the sum of N13.2 billion out of the subsidy funds received by his company was not sustainable and therefore not good enough to attract any subsidy.”

In a counter affidavit deposed to by counsel to the Attorney General of the Federation, the AGF stated, “the report of the committee which is a fact-finding committee will be studied and given to the relevant agencies of government but (government) will not prosecute or take legal action against the person or persons indicted by the report.”

Justice Gladys Olotu adjourned the case till October 18, 2012.
