Unity Bank MD, two others risk jail term for contempt of court

The Bauchi State High Court has ordered that form 48 and 49 be served at the Managing Director of Unity Bank and two others for their inability to obey court order and risk going to jail for refusing to appear in court.

The Plaintiff Attaib Mahmood had earlier filed a suit against the Unity Bank PLC, Hexalix properties Ltd, Mohammed Hassan, Ministry of Lands and Survey, Bauchi State and Commissioner of Justice, Bauchi State.

The Plaintiff had alleged that the entire suit borders on a transaction for the sale of property at Katagum Sarki road Azare in Bauchi State, covered by Certificate of occupancy No.BA/37 in the name of Bank of the north, and the sale was done through a bidding process which he won, but the Bank and Hexalix company changed the rule in favour of Mohammed Hassan and he prayed the court to stop the transaction pending the determination of the suit. His plea was granted by court.

Adding that, the defendants went ahead and sold the property to Hassan Mohammed,the plaintiff asked the permission of the court to
serve them with form 48 and 49 which the court bailiff said he was unable to serve them.

When the case was mentioned on Thursday, Counsel to the Plaintiff, Barrister Blessing Ada Esinwoke moved a motion experte and asked the court to order for substituted services to Unity Bank’s Managing Director, Hexalix Properties and Mohammed Hassan.

The Counsel further stated that the affected officers were out to frustrate the contempt proceedings initiated against them for
disobeying court order, and asked the court to grant the application in the interest of justice.

Justice Ibrahim Mohammed Zango, in his ruling on Thursday, ordered for substituted service of form 48 and 49 and other processes relating to the contempt proceedings against the respondents, by passing same on their last known address situated at No 6 Mediterranian street, Imani Estate Maitama Abuja, Plot 785 Herbert Macaulay way Central Business District Abuja, and Unity Bank Nig. PLC Azare Branch Bauchi State or serving them through their solicitors, M.A Abubakar and Co. suite No.4 Abba Zadawa c=Complex Ahmadu Bello way Bauchi.

The matter has been adjourned to 2nd, September, 2013 for hearing.
